Community terms and conditions
There are various areas of this website where you may add content or post comments or forum messages (including but not limited to Create Content and Community). The Unit Portal facilities including the community forums are provided by The Unit to you subject to the terms of this agreement ("Agreement"), and the rules that may be published from time to time by The Unit. The Unit reserves the right to change the nature of this relationship
at any time and for any reason.
The Unit Portal currently is provided as a free service to members and friends of the Unit who agrees to abide by the terms and conditions of this Agreement. Reading a message posted to the Community and posting a message to the Community or creating or editing content of any kind on this website will constitute acceptance of the terms and conditions of this agreement. If you do not agree to abide by these terms, please do not read or post messages or content.
COMMUNITY RULES:
You are entirely liable for all activities conducted by you or by others authorised by you or otherwise on your behalf.
A good rule of thumb is to respect everyone else who creates content or posts messages. Do not post or say anything that you would not say to someone's face. Do not make personal attacks.
You agree not to do any of the following actions while using this Portal:
1.To harass, threaten, embarrass or cause distress or discomfort upon another participant, user, or other individual or entity;
2.To transmit or publish via the Portal any information, data, text, files, links, software, or other materials ("Content") that The Unit considers to be unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, hateful, racially, ethnically or otherwise objectionable;
3.To impersonate on the Portal any person;
4.To disrupt the normal flow of dialogue in the Community forums or otherwise act in a manner that negatively affects other participants;
5.To post or transmit any unsolicited advertising, promotional materials, or any other forms of solicitation, except in any areas that are designated for such a purpose such as the Directory or the Sponsors' area; and
6.To intentionally or unintentionally violate any applicable local, regional, national or international law, including but not limited to any regulations having the force of law while using or accessing the Portal or in connection with your use of the Portal in any manner.
7.Any posting which violates these Standards will be removed and The Unit reserves the right to close accounts of any persistent violators of these Standards.
8. You may not, in the course of business, post any message or content on this Portal which amounts to investment advice or arranging a deal in an investment unless authorised to do so. There are serious penalties for conducting or attempting to conduct unauthorised investment advice on the internet.
9. It is your responsibility to ensure that any content that you post in this Portal does not infringe the provisions of the Financial Services and Markets Act 2000 and any law or regulation which supplements or replaces that Act. The Unit will assist any relevant regulatory authorities
in the investigation of any unauthorised postings and reserves the right to inform such authority of the identity of the person posting the message.
Our members must also respect the spirit and tone of our community. Breaking these terms and conditions which includes failing to respect the spirit and tone of the community or postings/ emails which demand a disproportionate amount of time and moderation by the Editors may result in your account being suspended or, in extreme cases, banned. The length of suspension will be at
the discretion of our Editors and can be permanent. If your account is suspended or banned, you will be prevented from posting on our forums, creating content or registering new accounts with us.
CONTENT:
You and any others authorised by you or otherwise on your behalf must evaluate, and bear the risk associated with, the accuracy, completeness or usefulness of any Content. The Unit shall not be responsible for any Content.
The Unit may display, modify, transmit, distribute or delete any Content which you upload or transmit to the Portal without needing further permission from you. The Unit does not however guarantee the publication of any Content. Much of the content on the Portal is subject to pre-screening and editing for suitability and messages in the forums are regularly moderated.
The Unit shall have the right, but not the responsibility, to remove Content which is deemed in The Unit's sole discretion harmful, offensive, or otherwise in violation of this Agreement or any rules The Unit has in place at the time. The Unit will at its own discretion monitor some, all or no areas of the Portal for adherence to this Agreement or The Unit rules.
The views expressed in the Portal, and particularly in the community forums are personal to the member and/or host and are in no way representative of the views of The Unit and are not to be taken to be endorsed by The Unit in any way.
WITHDRAWAL OF ACCOUNT:
The Unit reserves the right to prohibit those who breach the Terms and Conditions and to terminate any accounts the user might have. If your account has been withdrawn as a result of your breach of these terms and conditions, you may not open another account with The Unit and we reserve the right to terminate any such account.
DISCLAIMER OF WARRANTIES:
You expressly agree that use of the Portal is at your own risk. The Unit shall not be responsible to you for any content found on the Portal. The Unit expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
The Unit makes no warranty that the Portal will meet your requirements, or that the Portal will be uninterrupted, timely, secure, or error free; nor does The Unit make any warranty as to the results that may be obtained from the use of the Portal or as to the accuracy or reliability of any information obtained through the forum.
No advice or information, whether oral or written, obtained by you from the Portal shall create any warranty not expressly made herein. You understand and agree that any Content downloaded or otherwise obtained through the use of the Portal is done at your own discretion and risk and that you will be solely responsible for any damages to your computer system or loss of data that results in the download of such content.
LIMITATION OF LIABILITY:
To the full extent permissible under the applicable law, The Unit shall not be liable for any direct, indirect, incidental, special, consequential or other damages resulting from the use or inability to use the Portal or for the cost of procurement of substitute goods and services or resulting from any goods or services purchased or obtained or messages received or transactions
entered into through the Portal or resulting from unauthorised access to or alteration of profits, use, data, or other intangible properties whether based on breach of contract or warranty, tort (including negligence but not where resulting in death or personal injury), product liability or otherwise, even if The Unit has been advised of the possibility of such damages.
MINORS:
In cases where the use of the Portal by another individual, including a minor, is authorised by you or conducted otherwise on your behalf, you recognise that you are fully responsible for it: (i). The online conduct of such user; (ii). Controlling the access to and use of the Portal by such user; (iii). The consequences of any misuse by such user.
MISCELLANEOUS:
This Agreement shall be governed by and construed in accordance with English law, excluding any conflict of law provisions, and you agree to submit to the exclusive jurisdiction of the English courts for any cause or action arising out of this Agreement and any claims or allegations arising out of or connected with any message posted or read on the Portal. In the event that any
portion of this Agreement is deemed by a court to be invalid, the remaining provisions shall remain in full force and effect.
WHAT TO DO:
If you witness anything on the Portal that violates this Agreement or the Portal rules then please email the offending person's identification and cut and paste the relevant content into the Contact Us Form.
The Unit cannot guarantee that any action will be taken as a result of your email. Please refer to this Agreement from time to time for any updates The Unit may make to this Agreement and to the Portal rules.
